Response of National Trust on questions on the situation of the deafblind

Dear Sir,

 SUB : Request for information under Section 6 of the Right to Information Act, 2005.

Please provide us the following information pertaining to the welfare of people who are both deaf and blind in India and initiatives taken especially for them in compliance to the UN convention on the Rights of Persons with Disability.

Q 1. What is the number of the deaf-blind in the country? How many men? How many women? How many children of school-going age?

The UN Convention in article 4.1.(f) says “to undertake or promote research and development of universally designed goods, services, equipment and facilities, which should require the minimum possible adaptation and the least cost to meet the specific needs of a person with disabilities, to promote their availability and use......”

Q 2. What research or development has been undertaken till date of this application to comply with this article for people who are both deaf and blind to comply with Article 4.1.(f) of the UNCRPD?

Q 3. Please provide details of compliance to the Article 4.1.(g) of the UNCRPD. Please inform details of availability of Information and Communication Technologies, Devices and Assistive Aids made available to people who are both deaf and blind in India? What funds have been allocated towards this? What benefit a person who is both deaf and blind could get from these technologies?

Q 4. What numbers of people who are both deaf and blind are presently using these technologies in India?

Q 5. What efforts have been taken to provide information to persons who are deafblind and their caretakers about these assistive technologies to comply with the Article 4.1.(h) of the UNCRPD? What funds have been allocated in this direction?

Q 6. In compliance to the article 6.2 of the UNCRPD, what special initiatives and programmes have been initiated or launched to ensure full development and empowerment of women who are both deaf and blind? How many women beneficiaries have benefited from these programmes till date of this application? Kindly direct me to the webpage where the case studies could be read.

Q 7. What numbers of girls who are deaf and blind in the age group of 6 to 14 years are in schools and enjoying the benefit of education? Kindly provide information about rural and urban women separately.

The UN Convention in article 7.1 says “States Parties shall take all necessary measures to ensure the full enjoyment by children with disabilities of all human rights and fundamental freedoms on an equal basis with other children”

Q 8. In compliance with the Article 7.1 of the UNCRPD, what number of children (up to 14 years of age) with deaf-blindness are availing medical treatment in India? Kindly provide details of number of male and female children.

Q 9. In compliance with the Article 7.1 o the UNCRPD and the Right of children to Free and Compulsory Education Act, 2009, kindly furnish me details of inclusion of children who are both deaf and blind in normal schools. How many children who are both deaf and blind are in normal schools studying with other normal children? How many of them are male and female?

Q 10. They constitute what percentage of total children who are both deaf and blind in India?

Q 11. How many teachers are trained till the date of this application for taking care of education of children who are both deaf and blind in normal schools?

Q 12. In compliance with the Article 7.2 of the UNCRPD, please supply me a list of all special teaching learning materials which is in use for these deafblind children?

Q 13. What aid and assistance has the Indian state provided to people who are both deaf and blind, to help them express themselves, to comply with the Article 7.3 of the UNCRPD?

Q 14. What is the process to identify prejudices and harmful practices towards persons who are both deaf and blind, in order to comply with Article 8.1.(b) of the UNCRPD?

Q 15. In compliance Article 8.1.(b) of the UNCRPD, what prejudices and harmful practices relating to persons with disabilities, in particular to persons who are both deaf and blind have been dealt with so far? What was the procedure followed to address these?

Q 16. Kindly provide us details of activities undertaken for complying with Article 8.2.(iii) of the UNCRPD. As a result of these activities, what numbers of persons who are both deaf and blind in India have been employed in different sectors? Kindly provide details of sectors where they are employed?

Q 17. What steps have been taken by the National Trust in order to address the Article 9.1 of the UNCRPD, for the benefit of children who are both deaf and blind?

Q 18. Kindly provide me details of services as mentioned in Article 9.2.(e) of the UNCRPD for people who are both deaf and blind. What kind of assistance, intermediaries, interpreters are provided to people who are both deaf and blind in public places like hospitals, schools, railway stations, rail reservation counters, airports, restaurants, museums, zoo, planetarium, and other places of interest? Kindly furnish number of people employed by the Government for assisting them in each of such places in India.

Q 19. What number of government-run and privately-run hospitals in India has trained staff to assist people who are both deaf and blind? What number of people has been trained for the same?

Q 20. What number of government-run, government aided, privately-run schools in India have trained staff to assist children who are both deaf and blind? What number of people in these schools has been trained for the same?

Q 21. What steps have been taken in the direction of compliance with Article 9.2.(g) of the UNCRPD? What numbers of people who are both deaf and blind have taken the benefit of these till the date of this application?

Q 22. What amount has been allocated for this activity in each plan year and what amount from that allocation have been used for people who are both deaf and blind? In case no separate allocation and expenditure has been made for this, kindly share details of head under which allocation and expenditure has been made.

Q 23. What steps have been taken to comply with Article 9.2.(h) of the UNCRPD, which says “States Parties shall also take appropriate measures to promote the design, development, production and distribution of accessible information and communications technologies and systems at an early stage, so that these technologies and systems become accessible at minimum cost"? What numbers of children who are both deaf and blind in India have taken the benefit of these till the date of this application?

Q 24. What amount has been allocated for this activity in each plan year and what amount from that allocation have been used? In case no separate allocation and expenditure has been made for this, kindly share details of head under which allocation and expenditure has been made.

Q 25. Kindly furnish details of efforts which have been made till date of this application for persons who are both deaf and blind, to comply with the Article 11 of the UNCRPD which says "States Parties shall take, in accordance with their obligations under international law, including international humanitarian law and international human rights law, all necessary measures to ensure the protection and safety of persons with disabilities in situations of risk, including situations of armed conflict, humanitarian emergencies and the occurrence of natural disasters."

Q 26. What measures have been taken for persons who are deaf and blind "to provide access by persons with disabilities to the support they may require in exercising their legal capacity" to meet Article 12.3 of the UNCRPD? If, till date no steps have been taken to comply with this article, what is the plan for this?

Q 27. Please inform, in compliance with the Article 13.2 of the UNCRPD, what number of trainings have been provided to those in the field of administration of justice, including police and prison staff for ensuring effective access to justice for persons with disabilities and in particular for persons who are both deaf and blind? Kindly share the details of date of the programme and number of persons who have attended the programme?

Q 28. Kindly furnish details of efforts which have been made till date of this application, for persons who are deaf and blind, to comply with Article 16.1 of the UNCRPD. Article 16.1 says "States Parties shall take all appropriate legislative, administrative, social, educational and other measures to protect persons with disabilities, both within and outside the home, from all forms of exploitation, violence and abuse, including their gender-based aspects."

Q 29. Kindly furnish details of efforts which have been made till date of this application to comply with the requirement in Article 16.2 of the UNCRPD, for people who are both deaf and blind.

Q 30. Kindly furnish details of efforts which have been made till date of this application, for people who are both deaf and blind, to comply with Article 16.4 of the UNCRPD which says "States Parties shall take all appropriate measures to promote the physical, cognitive and psychological recovery, rehabilitation and social reintegration of persons with disabilities who become victims of any form of exploitation, violence or abuse, including through the provision of protection services. Such recovery and reintegration shall take place in an environment that fosters the health, welfare, self-respect, dignity and autonomy of the person and takes into account gender- and age-specific needs."

Q 31. What mobility aids, devices and assistive technology has been till date of this application been designed for people who are both deaf and blind, to comply with Article 20.(d) of the UNCRPD? How many people in India are currently taking benefit of these assistive technologies?

Q 32. Which groups/bodies have been supported for producing mobility aids, devices and assistive technologies for people who are both deaf and blind? What funds have been allocated in each plan year and expenditure been incurred for each plan year?

Q 33. Kindly furnish details of steps taken till date of this application to comply with Article 24.5 of the UNCRPD? What efforts have been made to help them access general tertiary education, vocational training, adult education and lifelong learning without discrimination and on an equal basis with others?
