SUB: Grievance: falsehoods and misinformation regarding public services for the disabled

This is to inform you on the matter below and seek action against the concerned officers for providing wrong information to the RTI query and telling lies on facilitating public services for the mentally challenged.

1. I posted a Right to information query to the Ministry of Social Justice and Empowerment on 26-08-2008, to seek information on computer software for mentally challenged persons. (letter enclosed)

2. To this I received a response from the National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities on 18-09-2008 (letter enclosed) saying "during financial year 2007-08 the budget of Rs. 5.0 lakh was provided for development of software and setting up of information kiosks" and "the kiosks were also installed in 6 hospitals in Delhi on non-commercial basis and are at the initial stage of functioning at Government hospitals".

3. Following this I posted a Right to Information query on 16-12-2008 to the National Trust for the Welfare of Persons with Autism, Cerebral Plasy, Mental Retardation and Multiple Disabilities, seeking information on the 6 hospitals where the information kiosks are installed, and their location. (letter enclosed)

4. I received the response to my queries on 7 January 2009 which provides dates and locations of installation as follows:-

5. Already from this, it was clear that the above mentioned letter dated 18-09-2008 contains a falsehood, for even according to the January 7 2009 information, kiosks had only been installed in 5 hospitals.

6. My colleague Mr. Sudhir Joshi, went to AIIMS, Safdarjung Hospital and Lok Nayak Jai Prakash Hospital on 04-02-2009, 10-02-2009 and 10-02-2009 respectively. He could not locate Information Kiosks in any of these 3 hospitals. His statement has been enclosed herewith.

Hence, the information in the letter dated 18-09-2008 and reconfirmed in the obne dated January 7, 2009, that the Information Kiosks were already installed and were working in all the 6 hospitals, seems to be a lie as well.

I request you, in light of the clear and documented facts placed before you and the gravity of the situation of people with mental challenges, that the matter be given an early hearing.

Kindly refer to your letter dated 07-03-2009 on the above noted subject. The matter related to Right to Information Act for a scheme of National Trust. As per the provision of the Act, if you are not satisfied with the information furnished, you have to approach the appellate authority. The Joint Secretary and CEO of the National Trust, Sri Atul Prasad is the appellate authority in this case. Kindly send your appeal to him in this regard.

Sub: Request for information under Sec.6 of the Right to Information Act, 2005.

I filed a compliant with the Director of Public Grievances in Ministry of Social Justice and Empowerment, regarding giving falsehoods and misinformation regarding public services for the disabled under the RTI Act by the National Trust. The complaint is as follows.

Thereafter, by way of verification of the information provided, my colleague, Mr. Sudhir Joshi went to AIIMS, Safdarjung Hospital and Lok Nayak Prakash Hospital on 04-02-2009, 10-02-2009 and 10-02-2009 respectively, to get information from the information kiosks. He could not locate Information Kiosks in any of these 3 hospitals. His statement has been forwarded as enclosure to the complaint. 
 
In its letter dated 18-09-2008, the National Trust had stated that the Information Kiosks were already installed and were working in all the 6 hospitals. Thereafter, by a letter dated 7-01-2009 the National Trust informed that the Information Kiosk at the AIIMS was installed on 23-12-2008, contradicting its earlier letter dated 18-09-2008.  No response/clarification was provided about information kiosks allegedly installed in the two other hospitals visited by my colleague.  

Since the issue involved as very important, pertaining as it did to provision of basic public services for the welfare of people with mental challenges, I requested for a personal hearing.  Thereafter, I inquired about the status of my complaint (i.e. request for personal hearing) with the Ministry on 6-4-2009, 8-4-2009 and 15-4-2009, and came to know that the complaint have been forwarded to the National Trust. In light of this please provide me the following information- 


    Q.1. What action is planned to be taken on the basis of this complaint? Kindly supply me a copy of the same. If the matter is not yet decided, please state reasons for the same. And indicate by what time the matter will be decided? 
     
    Q.2. Being the matter of grave concern for the children and caregivers  of person with autism, did the Ministry verified installation of Information Kiosks in the said 6 hospitals? If Yes, please furnish me a copy of the report. 
     
    Q.3 If the facts were not verified, please give me reasons as to why without verifying the facts the complaint have been forwarded to the National Trust for a response, against whom the complaint was submitted? Is this not pre-informing the National Trust to manipulate the evidence and install information kiosks in the hospitals before any such inspection?


    Q.3. It is about 2 months since the complaint have been submitted. Kindly inform the date of hearing for this matter.
